AAPS files motion in Limbaugh case

Together with the Florida Pain Initiative and the National Foundation for the Treatment of Pain, AAPS filed a motion for leave to file an amicus curiae brief on behalf of talk-show host Rush Limbaugh before the 4th District Court of Appeal in Florida. Limbaugh is being investigated for the crime known as “doctor shopping.” AAPS Executive Director Jane Orient, M.D., said this amounted to obtaining a second opinion, unbiased by knowledge of the first doctor’s opinion (Insight on the News).

The statute reads:

Florida Statute 893.13(7)(a)(8): "To withhold information from a practitioner from whom the person seeks to obtain a controlled substance or a prescription for a controlled substance that the person making the request has received a controlled substance or a prescription for a controlled substance of like therapeutic use from another practitioner within the previous 30 days."
