AAPS files amicus brief asking court to reverse 20 year sentence for prescribing pain medication

On December 29, 2011, AAPS filed an Amicus Brief with the Supreme Court of the United States asking the Court to reverse the 20 year sentence given to Perry Reese, MD, a rural family doctor, for the alleged improper prescribing of pain medications.

The question posed to the Court is whether a physician can be properly convicted for his medical decisions, and sentenced to imprisonment for 20 years, without proof beyond a reasonable doubt that he had criminal intent, mens rea, by acting with an illegitimate medical purpose.
