AAPS Tells Supreme Court – House and States Have No Standing to Appeal Ruling that ACA is Unconstitutional and Invalid

On February 3, 2020 the Association of American Physicians and Surgeons filed an Amicus Brief with the Supreme Court of the United States opposing the petitions of The U.S. House and Democratic States, led by California, asking the court to overturn lower court rulings that invalidate Obamacare.

The brief reads in part:

The House and State Intervenors cannot and do not speak for the United States, and when the United States informed the Fifth Circuit that it was no longer challenging the District Court’s decision, the appeal should have been dismissed immediately. Both the House and State Intervenors lacked standing below and thereby lack standing to petition for certiorari here.
