AAPS News October 2022 – Criminalizing Dissent

President Biden famously said: “For those brave right-wing Americans…if you want to fight against the country, you need an F-15. You need something little more than a gun” (https://tinyurl.com/58mmvn5j). A gun is also of no use against SWAT teams in riot gear, search warrants, subpoenas, indictments, prison terms, and crushing fines.

  At present, the FBI is concentrating on those who question the 2020 election results or who might strongly and effectively support pro-Trump or anti-leftwing candidates in future elections.

In what Tucker Carlson called a “full-scale purge” of Trump supporters, about 50 very broad search warrants and/or subpoenas from the “Capitol Siege” section of the Department of Justice, demanding communications relating to election irregularities, were served. Such activities are, we thought, protected by the First Amendment (https://tinyurl.com/2jr3r2ye).

But it’s not just about electoral politics, and it’s not new. Melania Trump’s wardrobe was searched for documents. Decades ago, agents searched shoeboxes in a physician’s closet, looking for medical records in a failed attempt to prove Medicaid fraud (AAPS News, June and November 1990, August 1992). Agents pointed a gun at an innocent physician’s 9-year-old son, while searching his home for records (AAPS News, July 1997).

Mike Lindell of MyPillow, prominent in alleging election fraud, had his cell phone seized, keeping him from conducting his business. Two top Trump advisors also had their phones seized, according to Judicial Watch. Many physicians have had their computers and patient records seized in the War on Drugs.

It’s forever war: on healthcare fraud, on drugs, on terrorism,  on a virus, on “climate change,” on “misinformation,” on “white supremacy,” on “extremism.” An FBI whistleblower stated that agents are now pressured to label cases as “domestic violent extremism.” The increasing cases being identified throughout the country are all connected to Jan 6 (tinyurl.com/4m7wpnub).

When Did It Begin?

Some say it started in 2001 with 9/11. A quantum leap in federal power and surveillance resulted when the PATRIOT Act quickly emerged from somewhere full-grown. Americans were  reminded of the horror, again, in the 21st anniversary memorial.

Is the 9/11 Narrative a test of Americans’ credulity? We repeatedly see planes crashing into WTC-1 and WTC-2, but not the  late-afternoon collapse of WTC-7, purportedly due to a few office fires. Yet an enormous recent fire in China failed to bring down a 42-story skyscraper (https://tinyurl.com/yhpzjk6h); indeed, WTC-7 is the only skyscraper ever collapsed by fire.

There are other questions, and conspiracy theories. Recall the original conspiracy theory about the assassination of President Kennedy: that Lee Harvey Oswald, acting alone, did not kill JFK. A single accomplice creates a conspiracy. Did Osama bin Laden, acting alone, orchestrate 9/11 from a hospital bed in Pakistan (https://tinyurl.com/5dwy4fa3)?

If the official Narrative is true despite many contradictions and the rapid destruction of evidence, it raises serious doubts about the capability of U.S. F-15 and F-16 air defenses.

To the regime, the events of Jan 6 are comparable to those of 9/11, except that the former was an “inside job” involving many co-conspirators who are still being tracked down. One woman was awakened by three armed FBI agents the day after Biden’s anti-MAGA speech, on the basis of a false anonymous tip that she had been at the Capitol on Jan 6 (tinyurl.com/36dmb25v).

Apocalyptic, “existential” threats, to Americans emotionally primed by the image of the rapid destruction of two of the safest structures in the world, have much of the population in a state of chronic terror, longing for government-ensured safety. Perhaps that accounts for the results of a Rasmussen poll. Asked about Biden’s assertion that “Donald Trump and the MAGA Republicans represent an extremism that threatens the very foundations of our republic,” 48% of likely voters agree, including 36% who strongly agree. Only 47% disagree, with 39% disagreeing strongly, reports Paul Craig Roberts (https://tinyurl.com/576xf6dj).

The COVID-19 Test

COVID-19 measures are the test for compliance and “social responsibility,” which billions of people passed, states Mridul Kaushik, mission director for the Smart Cities Mission of the World Economic Forum. Similar measures are being extrapolated into WEF “climate change” protocols (tinyurl.com/39the9zm).  People will only be able to rent, not own, what the system permits—no cash. Deprivation of access to food and energy could suppress dissent with no need for prosecution (and due process).

As EU Commission president Ursula von der Leyen said prior to the election of Giorgia Meloni as prime minister of Italy, “We will see the results of the vote in Italy. If things go in a difficult direction, we have tools” (https://tinyurl.com/bdzbfk92).

Germany is leading the way. Dissenters from COVID measures are not just being stigmatized and demonized, but criminalized as dangerous “extremists,” who are “anti-democratic and/or delegitimizing the state in a way that endangers security.” For example, they protest non-violently, or speak out against, or criticize, or satirize the global ideology called the “New Normal” (https://tinyurl.com/ydss42sz).


Flashback

The COVID-19 pandemic response is eerily similar to the response to smallpox 135 years ago, when vaccination mandates were accompanied by increasingly harsh punitive measures, writes Steve Kirsch. “The solution then was not trying to convince decision makers using rational scientific arguments. It was a mass public protest that resulted in the abandonment of what the ‘experts’ were saying to do and adoption of new methods that worked that were opposed by the medical community” (https://tinyurl.com/mr2vtx9m). Vaccination still got the credit.

One example: By the end of 1868, more than 95% of the inhabitants of Chicago had been vaccinated. After the Great Fire of 1871, vaccination was made a condition of receiving relief supplies. A devastating smallpox epidemic hit in 1872. More than 2,000 persons contracted smallpox, of whom more than 25% died, with the fatality rate among children under 5 being the highest ever recorded (https://tinyurl.com/yc2vw4s5).


Vaccination Updates

Denmark Bans COVID Jab under Age 50. The Danish Health Authority, after previously banning COVID-19 shots for nearly everyone under age 18, has expanded the prohibition to age 50, unless patients are at “higher risk of becoming severely infected.” It said that “the purpose of vaccination is not to prevent infection with COVID-19,” and that there is already good immunity in the population (https://tinyurl.com/2txwembz).

EU May Mandate Shots. European Commission president Ursula von der Leyen stated that we have a horrible pandemic, and life-saving vaccines, but they are not being used adequately everywhere. About one-third of the European population is not vaccinated. Discussion is needed about making  vaccination mandatory (https://tinyurl.com/4j9xwjv6).

Excess Mortality. The European country with the second highest vaccination rate (Portugal) has the highest excess mortality, and the country with the lowest vaccination rate (Bulgaria) has the lowest excess mortality, but “correlation does not prove causality,” and “there’s nothing to see here,” says Mark Steyn (https://tinyurl.com/5axe6fzh).

Death Rate Higher in Vaccinated. Based on data from the UK Office for National Statistics (ONS), Dr. Marian Laderoute calculated that mortality from both COVID-19 and other causes was higher in vaccinated persons (2.16 times and 11.41 times as high, respectively, in December 2021). She states that rescinding the emergency use authorizations (EUAs) in May 2021 would have prevented nearly 400,000 deaths from all causes between Jun 1, 2021, and May 31, 2022 (https://tinyurl.com/mpnnr4y4).

Pregnancy Outcomes. In the thousands of pages of Pfizer documents that a court has ordered released each month, it appears that the outcome was known in only 32 of the 270 pregnancies that occurred in vaccinated women. Only one normal outcome was reported. Most of the fetuses or newborns died, writes Dr. Pierre Kory (https://tinyurl.com/ysaxrjv5).

Threats to the State

Surveillance of “Extremists.” The Office for the Protection of  the Constitution, the German domestic intelligence agency, set  up a new department specifically tasked with handling cases (such as coronavirus deniers) that “seek to delegitimize the state,” since they do not fit the mold posed by the usual, politically driven groups, including Islamic extremists. Psychologist and conspiracy expert Pia Lamberty said: “The danger of Querdenken [lateral thinking]” she said, “has long been underestimated.” When “deniers” drew 40,000 protesters to Berlin, a small number managed to jump police lines and climb Parliament’s outside stairs. This was characterized as an “attack on the heart of democracy” (NY Times 2/28/21, tinyurl.com/msfnwbxu).

California Senator Richard Pan. “These [anti-vaccine] extremists have not yet been held accountable, so they continue to escalate violence against the body public…. We must now summon the political will to demand that domestic terrorists face consequences for their words and actions. Our democracy and our lives depend on it…. They’ve been building alliances with white supremacists, conspiracy theorists and [others] on the far right” (Wash Post 2/28/21, https://tinyurl.com/4jhhkhhz).

Peter Hotez. “The [UN] and…governments must take direct, even confrontational, approaches…, and move to dismantle anti-vaccine groups…. Efforts…should include experts who have tackled complex global threats such as terrorism, cyber attacks and nuclear armament, because anti-science is now approaching similar levels of peril” (Nature 4/27/21, tinyurl.com/ya6bbe24).

Climate Police. The Ministry of Environment & Climate Change Canada (ECCC) is building a new facility in Winnipeg that will house a firearms armory, interrogation rooms, biological labs, and intelligence facilities. The Impact Assessment Act (IAA), which was quietly passed in the final days of Trudeau’s majority government, empowers agents of the Ministry of Climate Change to enter premises without a warrant to “verify compliance or prevent non-compliance with [the Act].” Climate Police may also prohibit access to the location entirely. Opponents say this has the potential to cripple the food supply (tinyurl.com/nhzvkv3).

Power Shift to NGOs. An incestuous network of elites was able to overwhelm governments and take control of the global COVID response, without accountability. The Bill and Melinda Gates Foundation is the most powerful organization, and Gates is also involved in Gavi, the Wellcome Trust, and the Coalition for Epidemic Preparedness Innovations (CEPI). Bolstered by contacts at the highest levels of Western nations and empowered by well-grooved relationships with drug makers, they form a kind of global health monopoly (tinyurl.com/yc7fdn4u)—according to Woke mainstream Politico, which would have dismissed these ideas as right-wing conspiracy theory one month ago.

The Court Versus the Left

The U.S. Supreme Court is no longer a belligerent in the culture war, writes Wesley Stine. Dobbs v. Jackson Women’s Health Organization reversed 20th-century liberalism’s biggest achievement, as accomplished in the Warren and Burger Courts, which consisted of finding increasingly creative ways to say, “The old separation of powers is abolished. We are the real legislature now.”

The Court found itself playing the role that Octavian and his heirs had played in first century Rome, Stine observes. Like early imperial Rome, the U.S. was still nominally a Republic, but its the elected arm had been relegated to the role that the senators, consuls, and tribunes played under the principate—their power was limited to those issues on which the emperor (in our case, the Supreme Court) did not have a strong opinion.

The Left is now losing on abortion, on guns, on religious freedom, and on the powers of regulatory agencies like the Environmental Protection Agency (EPA).

The ruling class is very angry. In Orwellian doublespeak, they insist that allowing the abortion issue to be resolved “by citizens trying to persuade one another and then voting” is an attack on democracy. Progressive leaders are dropping their support for judicial supremacy. The Court has lopped off one head of the many-headed hydra. “But the state courts, the universities, the press, the administrative state, and the major corporations are still lined up against the American people, and they will continue to wield the bulk of real power.” Restoring the Republic will be a hard struggle, with an uncertain outcome, in Stine’s view (Chronicles, August 2022, https://tinyurl.com/ycxfywj3).

“The court has only just begun to reshape the country,” laments editorialist Maya Sen (“Save the Supreme Court and Democracy,” Science 8/11/22). But reform is “not impossible.”


Litigation Briefs

NYPD Union Members Ordered to Be Reinstated. New York City police officers who were fired because of the COVID-19 vaccine mandate must be reinstated, ruled Manhattan Supreme Court Justice Lyle Frank. The mandate imposed a new condition of employment and issued enforcement beyond monetary sanctions prescribed in the law. The city said it would appeal, likely freezing the judge’s ruling (https://tinyurl.com/2hyxjn9p).

Freedom of Conscience. Physicians cannot be forced to do abortions or to provide transgender drugs or surgeries, ruled the 5th Circuit Court of Appeals in Franciscan Alliance v. Becerra. The Biden Administration and the ACLU were attempting to compel performance of these actions under §1557 of the Affordable Care Act (https://tinyurl.com/3cts2s4f).


Tip of the Month: The finest Supreme Court Justice of the last century was Robert H. Jackson, who never attended college and never graduated from law school. He presided in the 1940s and 1950s, and yet is denied credit by leftist law professors. In ruling for the religious liberty of a student, Jackson famously held, “Compulsory unification of opinion achieves only the unanimity of the graveyard.” One of his comments can come in handy amid so many tyrannical prosecutions today: “Any lawyer worth his salt will tell the suspect in no uncertain terms to make no statement to police under any circumstances.”


FBI Invades Home of Pro-Life Activist

At 7 a.m., 25 to 30 heavily armed FBI agents entered the home of Mark Houck, pointing their assault rifles throughout the house and terrifying seven children. Houk was taken away in handcuffs on a charge of assaulting an abortion clinic volunteer a year ago, a charge dismissed by the Philadelphia District Court.  Reportedly, Houck had pushed back against the man, who was verbally abusing his son. Houck has been indicted for violating the Freedom of Access to Clinic Entrances (FACE) Act, a felony charge that carries a prison sentence of up to 11 years, and fines of up to $350,000 (https://tinyurl.com/3kmnrbm8). Pro-abortion activists that are attacking pregnancy resource centers are also subject to FACE but are not being prosecuted, states Sen. Josh Hawley (R-Mo.) (https://tinyurl.com/5vpukjdf).


JAMA Bemoans Constraints on Agencies

The Supreme Court’s action on vaccine mandates limits the  federal government’s ability to flexibly protect public health, write Lawrence Gostin, J.D., et al. They cite justices dissenting in the OSHA case: it “stymies the Federal Government’s ability to counter unparalleled” threats (JAMA 2/22/22). Biden advisor Ashish Jha, M.D., is “deeply worried” that people are going to start unwinding other vaccine mandates. AMA president George Harmon, M.D., said the Court had “halted one of the most effective tools in the fight against further transmission and death from this aggressive virus.” AMA requires both the primary COVID series and boosters of all 1,200 workers, even those who never report to an office (Abbasi J, et al., JAMA 2/22/22).


Professional Civil Disobedience

According to the AMA Code of Medical Ethics, there may be times when physicians must accept, en masse, fines, licensure suspension, even imprisonment, rather than harm a patient. Past examples include Soviet imprisonment of political prisoners in psychiatric facilities, South Africans filing false reports on prisoners injured by police, and participation in torture. In today’s America, Matthew Wynia, M.D., M.P.H., suggests that professional associations consider supporting physicians who engage in civil disobedience on one issue: participation in illegal abortions: “to repair the moral fabric of our country and the integrity of our profession, which have been so injudiciously ruptured by the Supreme Court” (NEJM 9/15/22, https://tinyurl.com/t596u95b).


The Scarlet ‘E’

The late Angelo Codevilla wrote: “Asking Americans to label one another ‘extremists’ is the most ruinous thing that the woke oligarchy’s malevolent morons are doing to our country. They mean to criminalize insufficient deference to themselves.” Machiavelli recognized that nothing destroys republics more surely than placing anonymous accusations into the hands of rulers.

Codevilla cites the apocryphal story that when the Nazis demanded that Jews in Denmark wear a yellow star, all Danes, starting with King Christian X, put on the star. It is within our power to defang the accusation of extremism in a similar way, he suggests (https://tinyurl.com/4ck3nz2v).


Correspondence

A Model. Chinese officials look at the UK as a cautionary tale of a government placing “human rights above security.” Instead, Xi  Jinping encouraged implementing aspects of the U.S. “war on terror” following the 9/11 attacks. He said to “show absolutely no mercy” in the “struggle against terrorism, infiltration and separatism.” The “organs of dictatorship” are needed to deal with extremism. Prolonged isolation and detention of Uighurs for “vocational training” is justified by the language of disease. “Freedom is only possible when this ‘virus’ in their thinking is eradicated and they are in good health.” There has been resistance from local officials. In 2017, there were more than 12,000 investigations into party members for violations related to the “fight against separatism” (https://tinyurl.com/mppkjvv7).

In the U.S., failure to support “ruling authorities” (hospital administrations) can land a physician in a treatment center for “disruptive” behavior that applies similar methods. The “patients” may be on lockdown for months and not allowed to have any contact with spouse or family—not even phone calls. Coercive drugging may occur. In one case, we learned that a resident physician was threatened with electroconvulsive shock therapy unless he altered his attitude toward the ruling authorities (it was never actually administered). Where are we headed?

It’s the Money. Here’s the secret to the explosion of transgender surgeries. In 2014 Obama modified Medicare/Medicaid law to pay for this. Then in 2016 Obamacare forced such coverage onto private insurers. No wonder Johns Hopkins restarted its sex change program in 2015, and so many other institutions have gotten on the bandwagon. Just 3,256 gender transition procedures were performed in the U.S. in 2016; the next year, the number surged by more than 150%, and in 2020 surpassed 16,000 (https://tinyurl.com/4399cafr).

If you search my Substack for “rabbi,” “rabbis,” or a similar word, many articles come up, but not the one about rabbis misleading people on COVID jabs’ effect on fertility. “Science.” Dr. Paul Thomas is suing the Oregon Medical Board for $35 million (https://tinyurl.com/mu6cfc8t). Apparently, he did a study, got it published in a journal, and the state medical board suspended his license because they don’t like his findings. Whatever happened to free speech, free scientific inquiry? A plaque at the University of Wisconsin (1894) states: “Whatever may be the limitations that trammel inquiry elsewhere we believe that the great state University of Wisconsin should forever encourage the continual and fearless sifting and winnowing by which alone the truth can be found.”

Howling at the Moon. The administrative state and its voice, the corporate media, are having a temper tantrum over Supreme Court decisions—demanding that we “discipline” or ditch the “rogue” Court. Or even the Constitution or the Union itself. One might think that threatening justices and their wives would be more likely to warrant the term “domestic terrorism” than discussing the merits of early COVID treatment or the dangers of novel genetic vaccine technology. What is causing the extreme anguish is the Court’s attempt to leash the out-of-control Administrative State and bring it to heel. And to force Congress to stop delegating responsibility to a bureaucracy that has morphed into a corporatist inverted totalitarian state Mastiff.

Misinformed Rabbis. I have read that two respected Zionist rabbis said that the unvaccinated are not following rabbinical law and should be barred from worshipping in temples. They are ignorant of medical facts. Jewish law simply says that health should supersede any Talmudic law.
