AAPS asks Majority Leader McConnell to replace Sec. 4403 of CARES act with Sections 5 & 6 of Personalized Care Act

Dear Majority Leader McConnell,

Thank you for your leadership in these challenging times.

We are writing today to ask you to consider removing Section 4403, “Treatment of direct primary care service arrangements,” from the CARES Act, and replacing it with Sections 5 & 6 of S.3112, the Personalized Care Act.

Yes, flaws in the tax code that impede patients from simultaneously benefiting from Health Savings Accounts and Direct Primary Care need to be corrected. However, Section 4403 goes about solving this problem in a manner that unnecessarily imposes new harmful overregulation on both patients and the medical professionals caring for them.

Adding barriers and burdens would be especially undesirable considering the current situation facing our country. A better approach for patients would be to use the language from Sections 5 & 6 of S.3112, the Personalized Care Act.
