On Thursday, September 1, 2022, the Association of American Physicians and Surgeons (AAPS) joined the National Health Federation (NHF) in filing an en banc amicus brief with the United States Court of Appeals for the Fifth Circuit supporting upholding a lower court’s block of President Biden’s order mandating COVID vaccination for federal workers.
The brief reads in part:
Elections may have consequences, but tyranny should never be one of them. Biden does not properly have dictatorial powers over anyone. He is restrained by the limited scope of federal power over anyone’s personal life, including that of
federal workers. He is confined to what Congress has or has not authorized with respect to major questions such as a broad vaccine mandate against millions of people. Biden is further limited by fundamental principles of informed consent
that are deeply ingrained in our American legal system.
